2007 06: Man guilty of raping teacher

POH: A 21-year-old man was found guilty by a Sessions Court here yesterday of raping a 27-year-old religious teacher four years ago.

Judge Ahmad Nasfy Yasin ruled that the prosecution had proven its case beyond reasonable doubt while the accused had failed to raise a reasonable defence. The accused had entered the dormitory at Sekolah Agama Ma’ahad Al Aziz in Parit, Perak Tengah, on March 24, 2003, between 3.30am and 4.30am, and assaulted the victim until she became unconscious before raping her.

The accused was a juvenile at the time of the offence, four months short of turning 18.

The court was told that when the victim regained consciousness, she saw blood and her undergarments all over the bed.

The prosecution had also proven through a medical expert that the hymen tear was new and was consistent with the act of rape, the judge said.

In his defence, the man, who was neither related to his victim nor a student at the religious school, denied raping the woman.

The court postponed sentencing to July 13 pending a probation report.

The man was represented by counsel Mahinderjeet Singh while prosecution was headed by DPP Ahmad Shazilee.
