2007 05: Factory worker claims trial to charge of raping teenager

KUALA LUMPUR: A Sessions Court judge told a factory worker on Friday that sexual intercourse with an underage girl was considered rape because of her age.

Judge Datin Anita Harun reminded Muhamad Noor Rahmad, 22, that he should understand his situation correctly before recording his plea to two counts of statutory rape.

“Even if you think she (the victim) is your girlfriend and you had sex with her, it is still considered rape,” the judge told him here.

To this, Muhamad just nodded and appeared calm.

He then claimed trial to raping the student, then 15, at his PPR Sri Pantai Dalam home in Bangsar between 5.15pm and 6pm on April 19.

He also pleaded not guilty to a second charge of raping the same girl at the same place at 3pm the next day.

DPP Afzainizam Abdul Aziz proposed for the court to set his bail at RM15,000 in one surety saying that the offence was serious and involved an under aged girl.

He said the prosecution was concerned that the accused may try to disturb the victim who was staying near to his house.

Pleading for a lower bail, Muhamad said he had to take care of his mother and sisters with his income earned from a part-time job.

Anita then set his bail at RM15,000 in two local sureties who have permanent address here.
She fixed June 4 for mention.

He could not post bail.

Sex with underage girl is rape, judge tells accused

KUALA LUMPUR: A Sessions Court judge told a factory worker that having sexual intercourse with an underage girl is rape.

Judge Anita Harun advised Muhamad Noor Rahmad, 22, to understand this situation correctly before recording his plea yesterday to two counts of statutory rape.

“Even if you think she (the victim) is your girlfriend and had sex with her, it is still considered rape,” the judge told him.

To this, Muhamad Noor just nodded.

He then claimed trial to raping the 15-year-old student at his PPR Sri Pantai Dalam home in Bangsar between 5.15pm and 6pm on April 19.

He also pleaded not guilty to a second charge of raping the girl at the same place at 3pm the next day.

The girl was said to have followed another man, who is a friend of the accused, to the place of the incident.

The girl’s mother had initially lodged a missing person's report on the girl.

However, on noticing her daughter's pale face when she returned home six days later, she lodged a police report on April 23 on the alleged rape.

Deputy Public Prosecutor Afzainizam Abdul Aziz proposed that the court set bail at RM15,000 in one surety, saying that the offence was serious and involved an underage girl.
