2007 07: Cabbie among four held in Johor and Selangor for rape

JOHOR BARU: Four men – one here and three in Selangor – were arrested over the past two days for rape and molest.

At 12.30am yesterday, police picked up a 33-year-old taxi-driver here, following a rape and robbery report by a restaurant assistant.

The 41-year-old woman had boarded the cab at Jalan Siu Nam after returning from her workplace in Singapore at 10.30pm on March 25.

The taxi later picked up a male passenger at nearby Jalan Wong Ah Fook.

At Jalan Pelangi, the passenger pulled out a knife and demanded that the woman hand over all her belongings.

Johor police chief Deputy Comm Datuk Hussin Ismail said the victim handed over her bag, which contained RM1,300, S$200, a mobile phone and her passport.

After the passenger left, the cab driver drove the woman to an empty house, where he raped her.

In KLANG, police picked up three men on Tuesday, following complaints by two teenagers on Sunday.

The two 16-year-olds were raped in separate incidents at Taman Sentosa.

In the first case, the victim said a former schoolmate had invited her to his house, where she met two other men. The men took turns to rape her.

The girl lodged a report at the Puchong police station on Monday after relating the incident to her aunt.

Klang OCPD ACP Mohd Rodwan Yusof said a 19-year-old factory worker and a despatch clerk, 20, were picked up from a house at Jalan Datuk Abdul Hamid at 1.30pm on Tuesday.
Police are looking for the third suspect, aged 20, from Jengka, Pahang.

In the other incident, the victim’s father led police to a house in Jalan Hulu Baling, where they detained a 21-year-old forklift driver.

The father had reported to police that his daughter had not returned home on Sunday and had allegedly spent the night at the man’s place.

In KUCHING, Federal CID director Comm Datuk Christopher Wan Soo Kee told reporters that there had been a 28% increase in rape cases between January and May this year, compared to the same period last year.

He claimed, however, that the overall crime index in Johor, had dropped by 4.7% in the first five months of the year compared to last year.

2007 06: 60pc of rape cases happen on dates

KUALA LUMPUR: Every day, eight women and girls are raped. And more than half of the cases reported every year are date rapes.

These are the chilling facts revealed by the figures from 2004 till March this year released by the police Sexual Assault, Domestic Violence and Child Abuse Investigations Division (D11).

The number of rapes has been steadily rising, according to D11 assistant director Ong Hin Lan. Last year 2,428 rapes were reported, "and up until March, we have received 715 reports of rape".

And most of the reports — 60 per cent — involve date rape, which is hard to prove in court, she said.

It is easier to prosecute rapists when the victims are minors as they can be charged with statutory rape, which carries a mandatory sentence of eight years. "But it is harder in the case of date rape victims above the age of 18, as it often turns into a ‘she says; he says’ situation," she said in a phone interview with the New Straits Times.

Because evidence plays a strong role in rape trials, women should be mentally prepared for the worst case scenario of rape.

"Train yourself to handle an attack. Scratch the rapist, as skin cells collected from underneath the finger nails can be used to prove his identity," she said.

"And as disgusting and dirty as you might feel, do not shower or clean yourself. You might wash away valuable evidence. If you’re badly hurt go to the nearest hospital and they will know what to do.

"Otherwise go straight to the police station and lodge a report. Police officers are now trained to deal with rape victims.

"Do not change your clothes. If they have been ripped, put them in a plastic bag together with your undergarments and hand them to the police.

"But most importantly, Ong said, prevention is key. Rape is caused by three factors — the rapist, the place and the opportunity. The woman can control the last two."

A lot of date rapes happen because women are too trusting and follow their dates to unfamiliar places, or accept drinks without knowing exactly what is in them. Being vigilant really makes a difference."

2007 06: Average of eight rapes a day this year

RAPE cases have increased in recent years, with an average of eight cases a day in the first three months of this year, China Press reported.

About 60% of the 715 cases recorded between January and March were date rapes, with the victims mainly between 15 and 18 years old.

Quoting Asst Supt Ong Saw In from the police department’s rape and sexual abuse against women and children unit, the paper said most cases were reported in Selangor, Johor, Kedah, Kuala Lumpur and Sabah.

She said that contrary to popular belief that rape cases largely occurred in secluded areas, 458 of the cases occurred in houses and buildings.

ASP Ong said there was an average of 5.2 rape cases per day in 2005 but the incidents rose last year with reports of an average of 6.6 cases a day.

2007 05: Driver who raped stepdaughters gets deterrent sentence

KUALA LUMPUR: Ninety years’ jail and 18 strokes of the rotan!

That was what a Sessions Court here meted out on a lorry driver who raped and forced his two underage stepdaughters to perform oral sex on him.

The man, however, will only serve 30 years because most of the jail terms for the multiple charges are to run concurrently from the date of arrest on April 30.

The girls, aged 14 and 15, had lodged police reports on that day when their mother discovered that the elder one was seven months’ pregnant following a hospital check-up.

On each of the four counts of committing incest, judge Anita Harun imposed a 15-year jail sentence on the 40-year-old man and three strokes of the rotan.

On each of the three counts of forcing the young girls to perform oral sex, the judge ordered the driver to serve 10 years and caned twice.

The man did not show any emotion when he heard the verdict yesterday.

He had committed the offences in his bedroom and the girls’ room at their home in Cheras sometime in the middle of 2005 to April this year.

The court was told that he had married the girls’ mother in 1997. He raped them when his wife, a security guard, went to work.

The man first raped the younger girl sometime in mid-2005, after pulling her into his bedroom and forcing her to perform oral sex on him.

He also threatened to beat her if she told her mother about it. He repeated the crimes on her in December last year.

In January last year, while the elder girl was reading a book, he rubbed her cheeks and then pulled her to his bed and raped her. Three months later, he forced her to perform oral sex on him.

On another occasion, while the girl was washing dishes in the kitchen, he asked her to have sex with him and sometime in April this year, he raped her again.

He warned “nanti siaplah engkau (I will finish you)” if she told anyone about the incident and the girl, fearing that he would also assault his wife as he had often done, did not relate the ordeal to her mother.

Deputy Public Prosecutor Tetralina Ahmed Fawzi pressed for a deterrent sentence, saying that it was in the public interest and that the offences were serious.

She described the man’s actions as “heinous, sinful and disgraceful”.

Tetralina also asked the court to consider police statistics which showed a big increase in rape cases from 2000 (when 1,200 rape cases were reported) to 2005 (1,887 cases).

Man gets 30 years, rotan for raping stepdaughters

KUALA LUMPUR: For almost three years a lorry driver raped his two stepdaughters, aged 14 and 12, when his wife was at work.

He threatened them not to tell their mother and they obeyed for fear of being beaten. They were also afraid he would beat their mother.

He "disturbed" the children when they were reading or doing their homework and forced them to have sex with him.

His misdeed was only uncovered when the elder daughter complained of stomach pain. Her mother, a security guard, took her to the Kuala Lumpur Hospital last month and it was confirmed the girl was pregnant.

Both girls admitted that their stepfather had raped them.

Yesterday, the 40-year-old man admitted at the Sessions Court to four counts of incest, and three of forcing the girls to perform oral sex.

He was sentenced to 30 years’ jail and 18 strokes of the rotan.The man, from a low-cost flat in Jalan Peel, Cheras, was charged with:
• raping the 12-year-old victim about 10pm at their house in the middle of 2005;
• raping the same girl between 9pm and 9.30pm at the same place some time in December last year;
• forcing the same victim to perform oral sex on him some time in the middle of 2005;
• forcing the same girl to perform oral sex on him some time in December last year;
• raping the 14-year-old girl about 8.30pm some time in January last year;
• raping her when she was 15 about 3.30pm in April this year; and,
• forcing her to perform oral sex on him some time in January last year.

In mitigation, he appealed for the sentences to run concurrently from the date of his arrest on April 30.

Deputy public prosecutor Tetralina Ahmed Fauzi said his mitigation showed that he was not remorseful.

"He did not do this on one occasion but on many occasions and he threatened them," she said.

"His animal-like actions are not justifiable as it left his daughters traumatised and psychologically and emotionally scarred for the rest of their lives. They along with the unborn child will have a bleak future." Tetralina submitted that rape cases had been on the rise as in 2000 there were a total of 1,210 cases reported to the police and this had increased annually. In 2005 it spiralled to 1,887 cases.

"Incest is a heinous crime in any society and the punishment meted out should reflect this," she said, adding that the punishment should be given consecutively as they spanned a three-year period.

Judge Datin Anita Haron sentenced the man to 15 years’ jail and three strokes of the rotan for each rape charge and 10 years’ jail and two strokes for each of the oral sex charges. She ordered that the sentences pertaining to each victim be served concurrently. However, the sentences for offences against the two girls are consecutive.

"It would be very unfair to give you a concurrent sentence (for all the offences) as it involves two victims," she said.

2007 01: 40% of women are victims of domestic violence

PENANG (Jan 8, 2007): Nearly 40% of women in Malaysia are victims of domestic violence by their partners or husbands, Wanita MCA chief Datuk Dr Ng Yen Yen said.

She said the disturbing figure was released by the police based on domestic violence statistics for 2005.

"The figure is a concern for us, but there are still more of such cases which are not reported to the authorities due to fear or lack of awareness.

"This situation has caused such violence to be repeated on the victims, and it is also a contributing factor to the increased incidence of rape, child abuse and incest cases in the country."

Ng said many women accept domestic violence as part of their lives.

"This is wrong as women have to wake up and realise what they can do about it and how to make it stop," she told reporters after officiating at a talk on the prevention of violence organised by the Women's Division of the Malaysian Federation of Hainan Associations at the Han Chiang College here yesterday.

Ng noted that the problem of domestic violence appeared to be worsening.

"For example, there were 2.4 rape cases reported daily in 1993. This figure more than doubled to 5.3 in 2005.

"This situation is taking its toll not only on the women but also on the children, which is why this kind of seminar is important to disseminate information and (raise) an awareness among women of their rights," she said.

Ng also urged members of the public to report cases of domestic violence to the authorities or to non-governmental organisations.

"This is the first positive step to stop domestic violence and protect women from being victims in such cases," she said.
